My proposal would be to extract that code to a dedicated strategy class, for example ActivationStrategyInterface, and provide the current behavior as an ErrorLevelActivationStrategy.

My use case at the moment is to not activate the FingersCrossedHandler on certain 404 errors.

If you like the idea, I can provide an implementation.

Read the IRC discussion and yeah I agree, I typically use CRITICAL instead to avoid those bogus 404s, so I would welcome an improvement in that area. If you have time go for it.
